Understanding the Procedures for Vehicle CCTV and Audio Recording Compliance

The Information Commissioner’s Office (ICO) has provided guidance on monitoring workers and how to handle personal data responsibly.

1. Identifying a Lawful Basis

To legally collect and process personal data through CCTV or audio recording, you must have a lawful basis. This could include:

  • Consent from the worker – Operators can obtain workers’ consent before monitoring them.
  • Legitimate interest – If monitoring doesn’t infringe on workers’ privacy rights, you may monitor for business purposes.
  • Legal or contractual obligation – You might be obligated to monitor for regulatory compliance.
  • Public interest or protection – When protecting someone’s life or serving the public interest.

2. Special Category Data

If your recordings capture sensitive personal data such as race, religion, or political opinions, you must meet stricter rules. This requires:

  • A separate condition for processing special category data due to its sensitive nature, as processing such information is generally prohibited by default under data protection laws.

3. Conduct a Data Protection Impact Assessment (DPIA)

Before installing any CCTV or audio recording equipment, it’s advisable to conduct a Data Protection Impact Assessment (DPIA). This assessment ensures you carefully consider how to lawfully implement surveillance and helps demonstrate accountability. The DPIA should include:

  • A review of how data will be used and stored.
  • Discussion with workers about the monitoring system.
  • Consideration of any other individuals who may be captured by the surveillance, such as passengers.

4. Communication and Policies

Clear communication with your employees is critical. Workers need to be aware of the monitoring system before it is introduced. It’s also important to ensure new employees are informed from the start. Organisational policies should reflect these practices, so all staff understand their rights and the purposes behind the monitoring.
